Warranty conditions
for garage door, swing gate, sliding gate and industrial door operators, barriers, tubular motors, radio equipment and accessories
Thank you for selecting products from SOMMER Antriebs- und Funktechnik GmbH.
In addition to the dealer’s statutory warranty arising from the purchase contract, we offer the following parts guarantee from the SOMMER date of invoice:
- 5 years on the operator system, motor and motor controller
- 2 years on radio equipment, accessories, tubular motors and barriers
Consumables and wear parts, e.g. batteries, light bulbs etc. are excluded from the warranty.
The warranty period for remedial work and subsequent deliveries is 6 months, but at least the current warranty period.
Making a claim under the warranty does not extend the original warranty period.
Requirements
The warranty is only valid in the country in which the product was purchased. The product must have been purchased via a sales channel specified by SOMMER. A corresponding purchase document must be available and submitted. Indirect customers of SOMMER must contact the business partner from whom the product was purchased.
The warranty applies exclusively for damage to the contract item itself.
The overall system (e.g. operator and gate/door) was serviced in accordance with the applicable standards (e.g. ASR A1.7) at the prescribed intervals. Corresponding documents must be submitted in evidence of this.
SOMMER industrial door operators in the GIGAsedo, GIGAroll and GIGAspeed series are generally designed for a service life of 500 operating hours (sum of door opening and closing times) and are thus endurance tested under rated load and in compliance with the specifications. Adherence to the specifications, regulations and standards given in the installation and operating manual is a prerequisite for achieving the intended service life. The nominal data are based on an ambient temperature of 25 °C and an altitude of <1000 m above sea level. When operating in the range of the limit values, it may be necessary to reduce the permissible torque and adjust the duty cycle. Compliance with the intended use and professional installation of the operator are preconditions.
Warranty services
Any defects in a product which can be proven to be the result of a material or production fault will be remedied by SOMMER within the warranty period. We undertake to either repair the faulty goods free of charge, to replace them with good ones or provide a partial reimbursement, at our own discretion. Ownership of replaced parts passes to SOMMER.
Please note that the voluntary manufacturer’s warranty applies exclusively to private use of the system. Private use is defined as a maximum of 10 cycles (OPEN/CLOSE) per day. Industrial applications with a significantly higher number of cycles must be agreed upon with SOMMER prior to purchase and on a case-to-case basis.
Reimbursement of expenses for removal and replacement as well as for checking of the relevant parts and claims relating to lost earnings and compensation are not covered by the warranty. Removal or obscuring of the type plate will render the warranty null and void.
Damage resulting from the following is also excluded from the warranty:
- improper installation and connection
- improper commissioning and operation
- mechanical damage caused by accidents, falls, impact
- external influences such as fire, water, abnormal environmental conditions
- repair by unqualified personnel
- negligent or deliberate destruction
- normal wear and tear or failure to perform maintenance
- the use of non-original parts
Obligation to notify
Claims may only be filed under this warranty if you notify us in good time of the defects to be remedied under the terms of the warranty. Notification must be received by us at the latest two weeks after the points at which the defect was first ascertained by you. Notification must be in writing or via e-mail.
Period of limitation
Claims under this warranty will lapse within 1 year from the end of the calendar year in which you learned of or should have learned of the circumstances on which the claim is based.
Applicable law
This warranty is subject to the law of the Federal Republic of Germany with the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).
Place of jurisdiction
Exclusive competence for any disputes relating to the rights and obligations arising from this warranty lies with the courts having jurisdiction in the location of the registered office of our company.
Valid from July 2021
